Real objections to Red Light Tickets that have been tested to work in California.
- Blurry photo – if the picture is blurry, you can object to the court that it was not you driving that day. The court will not require you to identify the person who was driving, thus the case will be dismissed. Vehicle code section 210 – requires that a photo be “clear”. So just go to court with the picture and tell the judge “this photo does not look like me” or “the photo is clearly a male/female and not me”. If that isn’t enough just say “your honor I respectfully request a dismissal as there is reasonable doubt that the picture is not me.”
- Collection Agency – Check to see if the ticket is actually issued by the court or not. Tickets that are issued by the court / police department will always included a printed picture and the address of the court on the letter. Many cities like Bakersfield, Del Mar, El Cajon, El Monte, Elk Grove, Emeryville, Encinitas, Escondido, Fairfield, Garden Grove, Gardena, Hawthorne, Inglewood, Laguna Woods, Loma Linda, Los Alamitos, Marysville, Maywood, Millbrae, Modesto, Moreno Valley, Oceanside, Paramount, Poway, Riverside, Rocklin, San Jose, San Leandro, San Mateo, Santa Ana, Santa Clarita, Solana Beach, South Gate, Stockton, Union City, Upland, Vista, Other California Towns, and Arizona Too use these phishing expedition to get people to pay over fines. Don’t fall for it.
- Yellow Light too Short – Vehicle Code Section 21455.7 states that yellow lights cannot be shorter than what is denoted in the Cal Trans Traffic Manual which is at least 3 seconds. So go to that intersection with a stop watch and time it.
- Lack of Photo Enforcement Signs – Vehicle code 21455.5(a)(1) – states that photo enforcement signs must be “visible from all directions” and “including, at a minimum, freeways, bridges, and state highway routes." Failure to abide by the state rules, invalidates your ticket. Thus, go around and take pictures of the few signs it has or failure to have visible signs as evidence and present it to the judge.
